The Journal of the Patent and Trademark Office Society has published the paper “Seven Words You Can Never Say to the USPTO” by Ryan Pool. This paper looks at the problem of patentability for BioTech (particularly diagnostic methods) and Computer Science patent applications because of 35 USC 101 and 112 Written Description and provides novels solutions to these problems for clients attempting to gain patent protection for these technologies.
