Biography:
Mr. Mandell represents clients in transactional, trademark, copyright and litigation matters. He has particular experience in music business deals including in connection with distribution, touring and live events, recording, publishing, production, merchandising and employment. Mr. Mandell has over twenty years' experience as a musician, performer, teacher, songwriter, band member and producer.
Representative Experience:
- Assisted client in the commercial releases of DVD containing live performances by licensing content and working on production and distribution agreements.
- Counseled producer of multi-city festival tour in business formation, sales of tour dates, clearance for creation of promotional compilation CD and performance, sponsorship and vendor agreements.
- Serves as outside legal counsel for independent record label Sumerian Records.
- Prosecutes trademarks before the USPTO. Works on inter partes proceedings before the TTAB. Maintains and enforces clients' intellectual property domestically and internationally.
- Works on internet and domain name matters such as UDRP proceedings and domain name transfer agreements.
- Participates in litigating commercial actions such as copyright and trademark infringement, trade secret misappropriation, unfair competition, breach of contract and employment disputes in federal and state court. Initiates actions, drafts motions and memoranda, attends oral arguments and takes depositions, drafts interrogatories and requests for production, works on settlement agreements.
